Roberto Hernandez, 56, was arrested Tuesday and booked into jail on charges including indecent exposure while observing a child and possession of an open alcohol container, according to the arrest report and NBC 6 South Florida.
The report says police were alerted to an alleged incident at Lummus Park on Ocean Drive. One witness told police he saw Hernandez with his pants unzipped and engaging in a sexual act while walking along the boardwalk. A father at the park told police he saw Hernandez watching his two young children as the family used the shower area after leaving the beach.
The report also describes a recording that showed Hernandez seated on a bench about 15 feet from the park’s shower stations. Officers found him on a bench with his pants unzipped and his sexual organs visible, beside a partly filled beer can, according to the account. He was taken into custody.
Under Florida Statute 800.03, unlawful exposure includes exposing or exhibiting sexual organs in public or being naked in public in a vulgar or indecent manner. A first violation is a first-degree misdemeanor; a later violation is a third-degree felony, according to the statute.
