The challenge, initiated by the American Alliance for Equal Rights, hinges on an interpretation of the Civil Rights Act of 1866, a law passed to protect the rights of newly freed slaves. Raoul and the coalition are adamant that the plaintiff's reading of the law is not only misinformed but also a blatant mischaracterization of the intent of a statute born from the struggle for civil rights. "Like thousands of other private organizations around the country, the Fearless Foundation provides crucial support to entrepreneurs and companies that have historically been denied access to capital," Raoul said in a statement obtained by the Illinois Attorney General’s office.

In an amicus brief submitted to the U.S. Court of Appeals for the 11th Circuit, the coalition argues that the legislation was never intended to prevent private charitable acts designed to aid historically marginalized communities. Citing the original context of the law, the attorneys general emphasize that Congress enacted the statute to combat discrimination against African Americans that affected their fundamental economic rights, including entering into commercial transactions. 

Notably, this coalition of attorneys general spans a diverse array of jurisdictions, including, but not limited to Colorado, Connecticut, Delaware, and the District of Columbia. All the more reason why Raoul and his colleagues are urging the appeals court to dismiss the plaintiff’s arguments and to uphold the lower court’s decision that protects the Fearless Foundation's initiatives. "I am proud to stand with my fellow attorneys general in strong opposition to this cynical attempt to end the Fearless Foundation’s important work," Raoul articulated, according to the Illinois Attorney General’s announcement.
