
Former NFL player Daniel Muir and his wife, Kristin, find themselves at the heart of a controversial judicial decision, as their legal representation challenges the constitutionality of their detention without bail. Arrested on July 3 on charges of obstruction of justice and domestic battery, the couple's case has stirred disputes over legal processes in Cass County.
According to Fox59, Daniel Muir, remembered for his stint as a defensive tackle with the Indianapolis Colts from 2008 to 2011, and his wife were taken into custody following a Silver Alert and a subsequent police raid that located their 14-year-old son at a religious compound in Logansport. Echoing the source, a WRTV report also indicates the filing of a Petition for Writ of Habeas Corpus by Muir's lawyer who branded the denial of bail as "unconstitutional under both state and federal law."
The couple's legal struggle comes after their son was found to have a black eye, which his grandmother, Cheryl Wright, alleged was the result of punishment from his father. According to court documents obtained by WRTV, Daniel Muir is heard on a recorded phone call essentially saying he had disciplined his son severely, claiming he whooped his ass like a grown ass man.
Further complicating the case is a probable cause affidavit suggesting Muir provided a video to Indiana State Police depicting his son in a wooded area, declaring in it, "my father did not punch me in the eye." Nonetheless, inconsistencies in the Muirs' story during a traffic stop raised red flags and led to their arrest. The WTHR report notes the defense's argument that keeping the parents from their son without bond is a breach of their constitutional rights, a claim made despite the judge's concerns over Daniel being a flight risk.
