A Chicago man, Luis Guzman Alvarez, has been charged with Aggravated DUI Causing Death after being accused of causing a fatal crash in Villa Park that resulted in the death of Jose Orizaba. Despite the severity of the charges, DuPage County Judge Joshua Dieden has rejected the State's motion to detain Guzman Alvarez before trial. According to information from the DuPage County State’s Attorney's website, the 49-year-old will instead be released on conditions that include wearing a secure continuous remote alcohol monitoring device, abstaining from driving, and reporting to Pre-Trial Services as mandated.
The collision, which took place on Sunday, saw Orizaba fatally injured when his Chevy SUV was struck by a minivan purportedly driven by Guzman Alvarez. Authorities claim the collision occurred when Alvarez, who allegedly had a BAC of .374, ran a red light at a high speed and then crashed into Orizaba's vehicle. Officers discovered two small open bottles of Jose Cuervo and small bottles of premixed margaritas and daiquiri in Guzman Alvarez’s vehicle. In a statement shared by the DuPage County State’s Attorney’s Office, State’s Attorney Robert Berlin expressed his condolences to Orizaba's family, underscoring the needless nature of DUI cases and urging public use of ride-sharing services to avoid such tragic incidents.
Villa Park Chief of Police Michael Rivas mirrored the sentiment, acknowledging the tragedy brought upon the Orizaba family and emphasizing the department’s commitment to rigorous investigation of DUI incidents.
