Three victims of a harrowing armed burglary at Flamingo Point, a Miami Beach condo, are now seeking $12 million in damages, claiming negligence on the part of the apartment complex and its security measures. According to Local 10, the legal action follows an incident last month where 31-year-old Brian Lopez managed to bypass security features and violently assault and rob residents.
The lawsuit was announced by attorney Bernardo Pimentel, II, who detailed the failures that allowed the breach of safety, despite promises of high-level security features at the complex. As Jacob Kirstein, one of the victims relayed his chilling encounter, "I was knocked to the floor and the blood was squirting out of my head, while I made eye contact with my fiancee," a quote obtained by Local 10.
Kylee Holland, another victim, expressed the emotional aftermath saying, "Since that night, I’ve been struggling with anxiety and a constant fear I never thought I would have," as reported by WSVN.
Lopez, now in custody and denied bond, entered Kirstein and Holland's residence after confronting Holland as she was taking out the trash. The assailant, armed and reportedly deranged, demanded entry and subsequently engaged in violence and robbery, which included a pistol whipping and coerced financial transfers via Zelle. Police were able to apprehend Lopez shortly after the incident, finding evidence linked to the crime in his possession.
The legal complaint implicates MCZ/Centrum Flamingo II; Apartment Income REIT; Florida State Protection Unit, a security services provider, in addition to Lopez himself in the suit. "No one, absolutely no one who lives in Flamigo Point, should ever have to experience what we did," Holland stated at a news conference, according to Local 10. Pimentel highlighted the glaring security breaches, as the assailant faced no resistance from supposed safety measures that should have prevented such incidents.
The civil lawsuit seeks to hold the property management and security company accountable, questioning how such an event could unfold under their watch. After the incident, Flamingo Point released a statement urging residents to lock their doors but has not publicly responded to the lawsuit. Lopez remains detained at the Miami-Dade County Pre-Trial Detention Center, facing multiple charges including robbery and home invasion with a firearm.
