
Miami Beach police have arrested a homeless man who they say attacked a woman near the shoreline early Saturday, ending a late-night trip to the sand in terror.
The suspect, 35-year-old Shawn Markiece Peete, was taken into custody Monday after hotel staff reported a man sleeping on the property. Officers responded and, according to police, connected him to an alleged sexual battery that occurred just off the beach. Investigators say the woman managed to break free, flag down a passerby, return to her nearby hotel and then call 911.
According to WSVN, the victim told detectives she had rented a hotel room close to Collins Avenue and later walked out to the sand to meditate when a man who introduced himself as “Shawn” and said he used the street name “Nike” approached her. She said he offered her tequila, which she pretended to drink before refusing. When he realized she had not actually consumed any alcohol, she told investigators, he became angry, pushed her down by the neck and raped her while she screamed and tried to fight him off.
WSVN reports that the woman escaped the encounter, flagged down a passerby and then went back to her hotel, where she contacted authorities. Detectives later reviewed city surveillance video that they say showed her speaking with a man matching the suspect’s description near Ocean Drive and 11th Street. According to the station’s account of the arrest report, staff at the Avalon Hotel called police after a department “need to identify” flyer circulated. Responding officers identified the man as Peete, who provided a DNA sample and, during questioning, admitted to having sexual intercourse with the woman but claimed it was consensual.
How the suspect was identified
The case highlights how investigators are leaning on surveillance footage and community tips to track suspects in Miami Beach’s nightlife corridors. Earlier this spring, a separate Ocean Drive assault drew attention to detectives’ growing toolkit of city cameras, witness statements and social media leads.
City officials and residents have been pressing for tougher responses after a series of unsettling incidents along the beachfront. Police, for their part, continue to stress that calls, tips and video from the public are often the missing pieces that let them build these cases.
Legal implications
Peete is facing a charge listed in the arrest report as sexual battery without serious personal injury. The offense is defined under Florida Statute Florida Legislature. Under that statute, sexual battery on an adult without force likely to cause serious personal injury is treated as a second-degree felony in many situations.
Under the state’s general sentencing scheme, outlined in Florida Senate materials, penalties for a second-degree felony can include up to 15 years in prison. Prosecutors will decide whether to seek any additional counts or enhancements as detectives and the State Attorney’s Office review forensic tests, surveillance footage and witness statements.

Court records did not list a next hearing at the time of the report. Officials are asking anyone who was near Ocean Drive and 11th Street around the time of the incident, or who may have relevant video or information, to contact Miami Beach Police.
