Kaden Lee Wineera Elkington, 25, was booked into the Cache County Jail on allegations that led to charges of third-degree retaliation against a victim, third-degree burglary of a dwelling, and Class A misdemeanor stalking. He remains in custody after telling the court he could not afford $5,000 bail, according to Cache Valley Daily.
What police allege
The allegations concern a Logan residence connected to a man Elkington was previously accused of assaulting in Brigham City on Aug. 26. The victim contacted Logan City Police on Sept. 16 to report continued harassment, according to KVNU News Talk.
KVNU reported that investigators reviewed home-surveillance video showing Elkington’s vehicle pass the residence several times before he went to the front door and allegedly tried to enter. The victim’s mother also told police that he came to the home seeking her son, behaved aggressively, and made threats. Police treated the alleged conduct as the basis for the retaliation and stalking counts.
Court and custody status
Brigham City officers found Elkington and transferred him to Logan police on Sept. 19, after which he was booked at the Cache County Jail, KVNU reported. He appeared in Logan’s First District Court by web conference, was declared indigent, and received a public defender. Cache Valley Daily reported that his next hearing was scheduled for Sept. 28.
Utah law classifies retaliation against a witness, victim, or informant as a third-degree felony under Utah Code § 76-8-508.3. The burglary charge is also listed as a third-degree felony, while the stalking allegation is a Class A misdemeanor, according to the cited statute and Cache Valley Daily.
Elkington is presumed innocent unless and until prosecutors prove the charges in court.
