The chain sells puffed cereal infused with liquid nitrogen called 'Dragon Breath.'

The project's sponsors hope to replace the restaurant with a new 4-story building.

In two years, the city has twice accused the eatery of violating rules for chain retailers.

Owner Mike Holland cited declining sales and high rent as contributing factors.

The café inside the supermarket will stay open, however.

After closing last June, the location operated briefly as a pop-up during the holidays.

The eatery has 15 days to correct the violation or appeal the notice of violation.

"Street crime has made things simply untenable for us," said owner Ariel Ford.
